Copyright Law
Copyright law protects a work from the time it is created in a fixed form for the life of the author/creator plus 70 years. From the moment it is set in a print form or an electronic or digital form, a sound recording, a computer software program, or other such concrete medium, the copyright becomes the property of the author/creator who created it. Only the author/creator or those deriving rights from the author/creator can rightfully claim copyright.
Work Made for Hire
If a work is made for hire, the person for whom the work was prepared is the initial owner of the copyright unless both parties involved have signed a written agreement to the contrary. A work created by an independent contractor [i.e., Philip Ré, REX Video Peoductions] can be a work made for hire only if there is a written agreement between parties specifying that the work is a work made for hire. Without an agreement in writing, all rights remain with the author/creator, even when acting as an independent contractor.
Commercial
License fees vary depending on the use, but generally fall between $55.00 and $500.00 per image for a one-year period, or otherwise agreed upon duration. Contact me at philip@rexvideoproductions.com for an estimate.
Non-Profit
Registered non-profit organizations may be able to license my work at discounted rates, or free of charge, depending on the context of use. Contact me at philip@rexvideoproductions.com for an estimate.
Classroom
Educational use by students, teachers, and researchers is free of license fees, and does not require prior permission as long as the use does not involve uploading images to the internet. If the project involves posting my photographs to the internet, prior permission is required and images must be accompanied by a visible photo credit to Philip Ré and a link back to www.rexvideoproductions.com.
I do not allow my work to be used in projects involving uploads to sites that apply a blanket Creative Commons license. This means my photographs cannot be used on Wikipedia, Wikispaces, and other similar sites.
Live Presentations
Participants of academic conferences are welcome to use my photographs in presentations and posters without prior permission. I require images to be accompanied by visible photo credit to Philip Ré.
Press Releases
I do not allow my images to be used in press releases without a full rights-transfer. Transfers can be purchased for a limited selection of unpublished photographs, starting at $500.00 per image. Contact me at philip@rexvideoproductions.com for an estimate.
Social Media – Commercial
Use of my photographs on social media sites or pages (Facebook, blogs, Twitter, etc.) by commercial entities is the same as “Commercial” use listed above and requires a licensing agreement. Contact me at philip@rexvideoproductions.com for an estimate.
Social Media – Personal
People acting in a personal capacity are welcome to share my photographs on blogs, web pages, and social media accounts without prior permission, provided that all images are accompanied by a visible photo credit to Philip Ré and a link back to www.rexvideoproductions.com. Failure to attribute an image properly may result in a takedown notice to the web host.
Derivative Artworks
Prior permission is required to copy all or parts of my photographs in derivative artworks. Some adaptations I may consider to be Fair Use, others will require a formal licensing agreement, and need pre-approval. Contact me at philip@rexvideoproductions.com for an estimate.
Copyright Infringement Policy
Unauthorized non-commercial uses of my copyrighted images and text are subject to DMCA takedown requests without advance notice.
Unauthorized commercial infringements of my copyrighted images will be handled by a contracted copyright enforcement organization, which may result in legal action to recover statutory damages as outlined in Title 17, § 504, of the United States copyright laws.
